Terms & Conditions

These terms govern the supply of recycling, collection and destruction services by Yang Trading Group Pty Ltd (ABN 18 668 537 451), trading as Yang Recycling, and the purchase of material from you.

TODO: solicitor to confirm the contracting entity, the order of precedence between these terms and any signed service agreement, and how variations are made.

TODO: quote validity period, how commodity price movements are passed through, minimum loads, rise and fall, and what happens when delivered material differs from what was quoted.

TODO: right to inspect and reject loads, contamination charges, prohibited materials, and what happens to rejected material left on site.

TODO: when title in material passes, warranties that the seller is entitled to sell, and the identification and record-keeping obligations imposed by the Scrap Metal Industry Act 2016 (NSW), including the prohibition on cash payment.

TODO: weighbridge weights as the agreed measure, calibration standards, and the dispute process where a customer disagrees with a recorded weight.

TODO: ownership of bins, balers and compactors, permitted use, damage and loss, access requirements, and removal on termination.

TODO: payment terms, methods, set-off, interest on overdue amounts and GST treatment.

TODO: liability caps and exclusions, consumer guarantees that cannot be excluded under Australian Consumer Law, and indemnities. This section in particular must be drafted by a solicitor.

These terms are governed by the laws of New South Wales, Australia.
